IDENTITY THEFT LIABILITY — Guide on A consumer’s Liability Following Identity Theft

Imagine waking up in Los Angeles and seeing strange charges on your credit card, or a loan you never applied for suddenly appearing on your credit report. Identity theft can feel overwhelming, but under federal and state law, you may not be responsible for those fraudulent debts at all.

R23 Law’s Consumer Credit Lawyers are here to explain what the law actually says, and how we help victims take back control—at no cost to you.

What Are Your Liability Limits for Fraud?

  1. Credit Card Fraud: Your maximum loss is $50, or $0 if you report early
Under federal law, if you report a stolen card before it’s used, you owe nothing. Even if used, your liability is capped at $50.

  2. Debit/ATM Card Fraud: Timing Matters

    • Report before unauthorized charges → $0

    • Report within 2 business days → $50

    • Report within 60 days after your statement → $500

    • Report after 60 days → Your loss could be unlimited

  3. Card Number Stolen (not the physical card)
If someone uses your card number (not the card), you’re not liable—as long as you report it within 60 days of the statement.
